  • I-864 Household Size Question

    Our situation is this:

My wife and I, my sister in law, and my mother in law reside in the same house.

My mother in law petitioned for her brother. There are 9 total family members.

Since the family size is large that is immigrating, my wife is going to be joint sponsor 1 and my sister in law is going to be joint sponsor 2.

My mother in law cannot financially support any family members, so my wife is sponsoring 5 family members and my sister in law is sponsoring the other 4 family members.

So on my mother in law’s I-864 she will have 10 persons in her household.

On my wife’s i-864 she will have 2 persons in household plus the 5 immigrants she is sponsoring?

On my I-864 a I will have 2 persons in household plus the 5 immigrants we are sponsoring?

on my sister in law’s I-864 she will only list herself in household plus the 4 immigrants she is sponsoring?

Based off of above scenario in part 3 of I-864, does my mother in law check “yes” in section 1 and then list off the 8 other immigrating family members?

My wife would check “yes” in section 1 and list off the 5 family members she is sponsoring?

Sister in law would check “no” in section 1 and then list off the 4 family members she is sponsoring?

In part 5 section 1 of the i-864 form does my mother in law indicate “9” for the number of persons being sponsored in this affidavit??

My wife would indicate 5 persons in part 5 section 1?

My sister in law would indicate 4 persons in part 5 section 1?

That sounds right, assuming you and your wife don't have any dependents, and your sister-in-law doesn't have a spouse or any dependents.

This is my personal opinion and is not to be construed as legal advice.

In part 3 section 29 of form I-864, my wife would indicate 5 correct?

Since my sister in law is sponsoring 4 family members (not including the primary beneficiary because my wife is sponsoring) does my sister in law state 4 or 5 in part 3 section 29?

The statement in part 3 section 29 says to include principal immigrant and family members, so it’s confusing.

          Thanks for your help!

          One last question I promise

          Form I-864 part 3:

My mother in law checks “yes” in section 1

My wife checks “yes” in section 1?

My sister in law checks “no” in section 1?

Or does my sister is law put checkmark in section 2?

Again my mother in law is petitioner, and there are 9 total family members.

My wife is sponsoring 5 family members

My sister in law is sponsoring the other 4 family members.

          The 9 family members include:

Husband (brother of my mother in law)
          Wife
          There 7 children

I think #2 should be checked on all three I-864s.

Lol only one section is supposed be checked in part 3 of that area:

Options are “yes” or “no” in section 1

              Or

              Checkmark in section 2

              Or

              Checkmark in section 3.

              Cannot select multiple areas.

I am not sure where you are getting that idea. Everyone filling out the form should check either "yes" or "no" in Part 3 item 1. And then if there are derivative beneficiaries sponsored, they also need to check the box in either item 2 or item 3.

This is my personal opinion and is not to be construed as legal advice.
