  • Confusion Over Which Forms to Complete?

    Good afternoon and Happy New Year!!!

    My wife is a US citizen, I am Canadian. We have been married for 5 years and currently reside in Ottawa, Ontario.

    We need to move back to Vermont to be able to care for her ailing mother.

    My wife is starting her new job in Vermont on January 5th. I am staying in Ottawa.

    We were married in Vermont.

    What forms do we need to complete in this situation, other than the I-130?

    I do not want to move until I am able to leave my current job and immediately start applying for on in the US.

    Thank you;

    She would just file I-130 for now. I-130 for spouse also needs I-130A, and various supporting documents (2 photos each, proof of her US citizenship, marriage certificate, various evidence of bona fide marriage).

    This is my personal opinion and is not to be construed as legal advice.
