We are in US on L1/L2 and our children are back home. They went to the US consulate for their L2 as dependants. The consulate sent them back twice with get this get that documents and the meanwhile one child turns 21. Now they have denied him saying he is not eligible and have approved the L2 to the younger one.Now is not other older one eligible as his application was put in before he turned 21? I mean they kept sending him back saying change your passport pictures, get pictures of your parents business, get proof that they are your parents. How can we appeal this? PLease help

    I'm so sorry to hear.......

I am not sure if CSPA (aging out) covers non immigrant Visas.............. but you perhaps need to retain an ttorney to fin dout if it does and for him to write a letter to the consulate asking them to reconsider their deciison.......I ...............doe he have paperwork showing that the embassy sent him back each time before he turned 21?...............you have to understnd though that the burden was on you to have ALL the supporting evidence at the date of the interview and that the CO had the discretion to deny the Visa ...........but you need an attorney
