    I?ve been an avid reader of this forum since we started gathering our evidences for concurrent filing. We are looking forward to pass it by end of January. But we came across this conflict on our I-864. My husband income for 2017 and 2016 is above the poverty guideline. But since it?s already 2018 tax season we are confused if we can use 2018,2017,2016 for the most 3 recent tax years but we just got his w2s so we havent filed it yet. Is it okay to list down 2018, 2017 and 2016 in the three most recent tax year even if we havent filed yet? Or we have to use 2017,2016,2015? But he didnt file his 2015 tax return because he was filed as a dependent by her eldest sister as a foster child. Please help!

    I encountered the same thing when I did the i864 for my wife, and now with the one I am doing for my step son.

    If I understand it, the NVC wants the last three tax returns that are completed at the time the i-164 was completed. The embassy might or might not ask for your latest tax return (even if incomplete) and your latest paystub at the interview.

    For my wife I included my 2014, 2015, and 2016 tax return with the i-864. But, the embassy asked for our 2017 tax return for her interview in June 2018.

    For my stepson, I included my 2015, 2016, and 2017 tax return with the i-864. His interview is going to be on Feb 11, 2019. The embassy asked for our 2018 tax return even if not yet complete. I was a bit puzzled by that myself. I just rushed though the forms, and will give them the incomplete return. I will file the real (amended return) once he gets a SSN.

    We are also bringing our pay stubs from this week to my stepson's interview on the 11th of February.

      Thank you for the answer. I guess we should just file our 2018 taxes first then!

        And i just found out that my husband is full time with his job but the company issues him a 1099 every year. Would it be a problem if the employer verification letter says he is a full time since 2016 but his taxes were all 1099?

          If the company issues a 1099, then he is an independent contractor and not an employee. The implication is he is self-employed. I do not know how that will work.
