  • Maximum age limit under f4 category

    Greeting to all !!

My sister has applied for me and my two children under f4 category (Brother and Sister) as per detail below

Case filling date ---31 July 2006
    case approval date --- 06 july 2009
My elder daughter's date of birth --30 March 1995

Now I am not clear that because she is going to be age out even under CSPA on 30 March 2019. She has done her study in Nursing filed and preparing for NCLEX Test also,.
Please advice me as now priority date is 1 feb 2005 and it may take 1-2 years to become current for me. I have information from this site as well as from some others that If we inform to the Concerned NAV for this position , then they will take note of it and will allow the child to go with you even at the age of 27 if she is unmarried status.

so please if it is confirmed kindly advice me what to do at right now to ensure that my daughter can go with me .

    thank you

    Hello,
I am facing same problem,my daughter is now 25 years of age and my priority date is Nov-2005. Though i have received the mail to process the application but I learnt that my daughter may not go with us. I also read somewhere that this can be waived by applying to NAV but unfortunately missed the link. Can you please share the site from where you got this information.

    Thanks,

    Zafar

No. If she ages out, she cannot immigrate with you. You would have to petition her after you enter the US, and it would be a new petition with a new priority date (the date you file for her).

This is my personal opinion and is not to be construed as legal advice.

Thanks for valuable reply. But I read from your site that we must inform to the NAV if your child is going to be aged out within 60 days . what it means??. and also I heard from some friends that If we do this , this may help to your aged out child to become part of your immigration process.

        Please advice
