  • Family based immigration question

    My father filed for his brother and sister. However, my father passed away 3 years ago. And recently my uncle and aunt have recieved the paperwork.

    Are they still eligible? My understanding is that they are not direct family anymore. Am I right? In either case, can I sponsor them or can my mom sponsor them?

    No. The petition dies with the petitioner.

    No, you can't file for a aunt or uncle.

      Just to make sure I understood you correctly. My father had already filed for them. So the whole process for my uncle is nullified? I am not sure what the exact steps are but dont they only need me to show Affidavit of Support?

        The petitioner is required to do an affidavit of support, even if someone elses income is also goingto be used. Check your inbox for a message.
