    Hi,

    My brother, who is a USC, is sponsoring me for Family based immigration.
    Does he need to file I-864 along with I-130 or he can file it later?

    yes, he has to file affidavit of support

    if u are present in the USA already during the time of filing:
    when he is filing all things concurrently (130,485, 131). 130 won't be approved unless you do that. AM sure you cnanot file concurrently unless it's a spouse/child/parent...

    If the relative is legally in the U.S., is doing Adjustment of Status (I-485), I-864 must be submitted along with I-485 application. If you have a joint sponsor, the joint sponsor must also complete USCIS Form I-864 at this time. If you are using the income of other household members to qualify, then each household member who is accepting legal responsibility for supporting your relative must complete a separate USCIS Form I-864A, Contract Between Sponsor and Household Member. If you are given specific instructions to file your affidavit of support directly with the National Visa Center, you should follow those instructions.

      The I-864 can be filed later........even when its concurrent (I-130, I-485) the I-864 can be given at the time of the I-485 interview and IO notarizes it.

        Actually it is not filed with the I-130 and that in your case it would be a I-134 which would be done later. he simply sends the i-130 with proof of the qualifying relationship.
