  • Need HELP WITH I-130 ASAP

    I ( I AM u.s citizen) filed I-130 ABOUT THREE WEEKS BACK FOR MY MOTHER WHO IS VISITING . I RECEIVED RECEIPT THIS WEEK. HER RECENT STAMP EXPIRES IN ONE WEEK. MY QUESTIONS ARE:
    1) CAN SHE LEGALLY STAY IN U.S EVEN IF WE DONT HERE BACK IN ONE WEEK AND HER VISA EXPIRES OR SHE HAS TO LEAVE THE COUNTRY?
    2) WHEN SHOULD I FILE I-485?

      My sister just received her I797c form stating an approval from BCIS Vermont. It says that they forwarded her paperwork to National Visa Center at New Hampshire. My mother, a permanent resident, filed her an I130 F2B. My sister is here in the US illegally. How long does the NVC process her greencard?

        The NVS is going to forward your sisters file to the consulate in her home country. Youre usually sent a packet within a month or two. Youll then receive another packet with the appt date for the interview. You say she is here illegally...........illegally as in an overstay or did she enter illegally?

              did you file i-485 concurrently? i did -- for my mom--- she is visiting and her visitor visa expires in 10 days -- and i still have not received receipt -- so i am confused now ---- i know she does not have to leave, as i am US citizen,,,, but can she travel within US?

                  what proff she needs to take w/ her while travelling in US? i don't want her to run into any trouble at the airport,, because they might stop her saying she has expired visitor visa on her passport ... what should i do?

                    All domestic airlines require is proof of identity, they cant ask her about her visa status

                      Hi,

                      I have a question regarding my mom's eligibility to stay in the US after I-130 has been filed

                      My sister and bil are citizens
                      They filed I-130 for my mom and received the receipt
                      They did not file I-485, yet
                      My mom's current I-94 for visitor visa expires in the second week of June

                      My questions:

                      1. Can she stay in the US after her I-94 expires? If she can, how long?

                      2. I know that they should have filed the I-485 at the same time as I-130, but, given the situation now, when can they file I-485?

                      3. What are the possible repurcussions if she leaves the US as originally scheduled, in June, without getting approval for I-130?
