  • My case is a mess

    Hi ,
    My mom petitoned for me in 1998. At that time she was a permanent resident.
    My priority date finally became current late last year according to the bulletin for that processing center. Here is the tricky part. My mother is a USC and I have gotten married with kids. What can I do ? It would really be heart breaking if I have to start all over again because I got married. Can anyone help me or guide me as to my next step?

    I would say the date of the marriage is important. Did you marry before or after your Mom became a USC?

        Its a little complicated and I hope that i'm sorting it out properly. hopefully someone really knows the answer and can help you out. But this is how I understnd it:

        if you got married before your mother became a USC you completely lose your eligibility under that petition which would mean yes, you'll have to start all over again.

        Had you marry after she became a USC then you would have moved to the third preference but kept the same priority date.

          Isn't there something else I can do? To start over is a bit unfair and you shouldn't have to put your whole life on hold because processing took or takes a very long time. Especially since there is no record of me getting married but I guess it will come up eventually. If anyone can suggest a way around this then I would be very grateful otherwise it is not worth it to continue for a much longer period.
