  • for my mom---

    i applied for my mom, who is visiting here, and her visa expires on august 11th.
    i applied concurrently w/485, i-130 on july 5th --- i got rejection notice saying:
    in i-130--- i need to be us citizen and 21 years of age ---- which i am -- i have attached my US passport, birth ceritificate, marraige certificate everything.

    so what do i do about that?

    and on I-485 they say that i need to file my original I-130 if i am filiing concurrently ---- which i had done --- all the forms were togather.

    so i am totally confused as what to do?
    please please people--- guide me ... ASAP

    Thats unfortunate...........however I think in the end you'll have to file again and pay the filing fees again because theres just no way you can prove conclusively that you did send the documents.

    Of course theres no way harm in writing and I think you should in fact do so but how can you going to really prove it ? Your only other recourse is to file a Motion to ReOpen the case but again the onus will be on you to prove that you did attach all the documents and that appeal cost almost $400.00 and will take at the minimum a few weeks. If you live near to an USCIS office , make appt and go in and talk with them as to how is the best way to proceed.

    Although its better to file while she is still in status, she can still file without leaving even if she's out of status because she is the immediate relative of a USC so you need not worry as much as youre doing about that part of it.
