  • Marrying US Citizen in India

    Hello,

I saw some threads here that talked about Indian citizen marrying US citizen in India but they first got married in US.

I (indian citizen) am marrying US citizen in India first and our US wedding will be after that. Currently, we both are in US. I did do some research before starting this thread and most places said that
    - US citizen needs "no-objection" certificate from US embassy but this is not possible as marraige records in US are not centralized.
    - Under Hindu marriage Act, person may need to convert to Hindu religion?
    - US citizen needs to stay in India for alteast 60 days before the marriage can be formalized.

I am all confused. Someone who has gone through this or have any idea on what we need to do in India or US to make the marriage legal in India and US.

    thanks for your time.

    Hello

You are really all mixed up.

    Here is the reality;

    1. The best way is for both of you to have a civil marriage first in India
Civil marriage laws do not require any conversion. And your marriage is
registered in the court which makes it perfectly legal and recognized.

    2. The 60 day law was meant for direct immigrant visa filing at the US embassy in India. It has nothing to do with the validity of the marriage.
The rule was; If the marriage takes place in India, and the US citizen
spouse wants to file for the immigrant visa for the Indian citizen spouse
direct at the US embassy in India , the US citizen could do so only if he/she
could show a continuous stay of 60 days in India. But that law is gone now.

3.Read this link for the US embassy NOC

      Peace,

Thanks for your reply. Yeah, its all mixed up. I did read the link you sent me and again, it says " If one of the parties is a U.S. citizen, the registrar may request a “no objection letter” from the U.S. Embassy or Consulate, and also may request proof of termination of any previous marriages, before a marriage certificate will be issued."....

how do we get "no objection letter". Marriage documents in US are not centralized so we have to get something from our state? any advice on that?

      Thanks,

THe link clearly states that the embassy will issue the letter , so I don't
        understand the problem.

          From this website: http://mumbai.usconsulate.gov/import...gulations.html

"Often, the registrar asks the foreigner to bring a letter from his/her Embassy certifying his/her marital status in the home country. As marriage records are not centralized in the United States, the Embassy is unable to give such letters."

My question is - Embassy will not have any record of marital status so how will they give a letter?

Even if they can, should I request it now cause I dont know the timeframe required. Embassy website doesnt really explain the process of requesting this.

          Thanks.

I suggest your US citizen to-be spouse write an email to the New Delhi embassy. They have
an email address for such queries:
            [email protected]

Still waiting to hear from the embassy. Is there a better way to reach them or contact someone here in US?

              Thanks.
