    Greetings All

    My wife (USC and Alabama resident) of 2.5 years filed a Green Card Petition (I-130 & I-485) for me in June, 2006 at the Mesquite, TX USCIS office and we received a receipt date of July 5, 2006 for the I-30. I was currently on an H1B visa but have not worked for that company since 2004 and expiration date on the H1B is October 2006. I am desperately in need of eligibility to work since our house and all our assets are being threatened .. income shortage. I have been offered several jobs with my degree, but every employee is waiting to see how my Green Card application process goes.

    My question is, do I need to file a I-765 form or do I need to wait to hear from INS for further instructions. I need an EAD ASAP, and I am not sure what is the best move.

    How do I proceed since my I-130 case is pending ... also what are typical waiting periods for EAD's.

    Please any advice will be greatly, greatly appreciated, my wife and I are confused and frustrated by our lack of clarity on how the process works.

    You ought to have filed the EAD along with the I-130 and I-485. You dont need to wait on anyhting from USCIS.........you qualify once you have a I-485 pending. The typical waiting period is around 8 weeks............th emaximum waiting time is 3 months

      So is it okay for me to go ahead and file the I-765, and which location would I send it to?

        yes...whereever you sent the I-485
