Sponsoring parents--Urgent!

Hi,

I am US citizen and planning to sponsor my parents. They also have 10 yr multiple entry visa to US.Have heard that the processing for parents green card is lil fatser if they r in US at the apply time. I am little confused with the procedure for green card in this case, so my questions are:

1. Can I file I-130 and I-485 at the same time when parents are here in US?

2. How long will it take to complete the process?

3. Can parents go back to India and enter US when I130/I-485 is being processed

Really apprceiate your input on this....have been spending so much time to figure out this stuff

Hi,

We decided to go for consular processing with parents in India when I apply....we thought abt this plan ...then decided that it will be too complicated ..as u have to care abt the legal/illegal stay if processing takes more than 6 months ..then apply for visa extension ...and then take advance parole I 131 to travel back and forth ...so thought of keeping it simple ....heard it takes max 9months -1 yr for immidiate relatives petition..which is not that bad

I didnot find anywhere which Vias category parents are in ? How long does it take ? Can someone forward me a link " Sponsoring Parents " so I can read .

Hello,

As you are a US citizen, they are immidiate relatives for you and there is no waiting period for them to apply for the Green Card.

Yes you can concurrently file the I-130 and I-485 together.

You also file for the Advance Parole in the same package. As, while the I-485, AOS is pending with the USCIS, you can not move out of US without obtaining AP. If you do so you will abandon your case for the AOS. The AP document is valid for 1 year and it is generally issued in 60-90 days time.
