  • Difficult times - my mom is alone - please HELP.

    My parents came to USA two times and both times they came on only
    one year visa. First time they came and left USA within 6 months
    and when they came second time on 6 month I-94, I applied for
    extension for 6 months and it got denied. They left USA after
    15 days of extension denial notice arrived.

    Now, my father passed away two months back and I am planning
    to get my mother here again to USA. I am really worried and
    confused on what to do. I really appreciate if some one can
    shed some light on this:

    I applied for my US citizenship last week. I maybe getting
    my citizenship done by December/Jan-07 as per the current stats.

    Assuming that my citizenship will be done in 4/6 months and also
    going by the current Visa appointment dates in India only after Feb/March, what should I do for my mother's visa?

    1. Should I ask her to try for visitors visa in coming months?
    advantage: if she gets visa, i can apply for her green card
    after she come here.. or if she gets multiple she can keep
    coming.
    [if her visa gets rejected, is it going to be a RED flag for her GC application?]

    2 As her extension got denied last time, her chances of
    getting B2 visa is very less. In that case, wait till I get
    citizenship and process her GC when she is in India.

    I really really appreciate on your advise..

      Hello,
      The application for B-2 visa will again require her to prove that she has social/professional ties in India and she will return home after the visit. And while the officials will know that she is being petitioned for the Green Card, which means she is having an immigrant intent which is in direct contrast to the requirements of B-2 visa, she will be denied the B-2 visa.

      It is best to get the Green Card for her.
