  • Family based immigration

    My eldest daughter (US Citizen) has filed 1-130 on 1.9.06 for my immigration to USA. I will prefer to go for Consular processing. My youngest daughter will be 21 on
    30th January,2007. Questions:
    01. Howlong it will take to complete the process ?
    02. Can my daughter migrate with me or will she be aged out by the the time process is complete for my immigrant visa.

    Any feedback will be highly appreciated.

    She will likely age out.............................it takes around 9 months to a year...........some people alittle quicker , some a little slower

      Many thanks for the response.

      I understand that upon approval of I-130, USCIS sends visa application to NVC. Since I am the immediate relative of an US Citizen, I need not wait for priority date.

      NVC says... if your children will turn 21 within 60 days notify NVC immediately so that your application can be processed quickly to ensure that your children can immigrate with you.

      Does that helpme any way !

        In fact.............your other daughter could only accompany you if your daughter was filing for you as a preference relative and not as an immediate relative so either way she ( your younger daughter)will not be able to migrate with you.

          I now understand that :-

          Either my eldest daughter can apply for immigration of my youngest daughter under F4 which involves waiting period of about 10-12 years.

          or upon my receipt of greencard say within a year, I can apply for her immigration under F2b.

          Which is the advisable step ?

              Dear Curiousone,

              Thanks again for your views & suggestions.

              I wanted GC only to expedite the case of my youngest daughter. If the processing time for
              F2b & F4 is almost the same, it may be prudent that my eldest daughter (Citizen) applies for GC of her younger sister residing outside USA.

              I visited USA many times & currently holding 5 years multiple B1-B2 visa, not very keen for a GC for myself.

              Kindly advise.

                  Children immigration

                  After collecting information from various sources, I am now convinced that if a green card holder parent applies for immigration of his unmarried children nearing the age of 21 (F2 b), processing time will be almost similar to F4, means waiting time of 8-10 years. This may not be prudent because by the time priority date becomes current, the children is likely to get married. and a LPR parent cannot sponsor married children. Under such situation the application will be void.

                  I have therefore decided to ask my eldest daughter (US Citizen) to sponsor her younger sister under F4. no matter how long it takes to get the approval.

                  There is no other way to expedite the process except that my youngest daughter may try to go to USA now under student visa (if granted) & ultimately apply for adjustment of status.
