    My sister has applied for me and family under F4 visa category. Our priority date is January 1996. At the time of application by her 10 years ago my daughter was 11 yrs. Now she is 21 yrs and 9 months.

    1) Will she be able to go with us since she is now > 21 yrs ? We have been sent a fee bill per person and she is not included in that. When we called NVC, the nice guy said that they can not do anything since she is over 21 and we have to explain that to the local US embassy when we are called for the interview, and the decision then is up to them. Can she proceed with us under the Child status Protection Act ? She is unmarried.

    2) The fees were sent by bankers draft. What is the next step ?

    Pls help.

    You could always try but its unlikley...............the petitioner ought to have informed USCIS 60 days prior to her turning 21 that she would age out before the interview.

      But is there any other way because she will be all alone here ? Can she get a student visa or will it be a problem at this stage ?

        She could always try but with a immigrant petition filed on he rbehalf and her mothe rand sister living in the uS, she will face an uphill battle

          My case is similar. Our priority date is 11/2002. My mom's sister have filed an F4 for us, and I am now 23 years old. Same case applies to my cousin brother who is 25 now. We have not notified NVC 60 days prior to our turing 21 in both the cases. But I hear from people now that they provide visa till 26 years but its mentioned 21 years of age in the official site. I would like to know whether we still stand a chance to migrate. Also, I could find through the visa movement that there was a lag and it dropped down 2 years in 2/2011. Will that drop down of 2 years be of anyhelp ?
