Want to Sponer brother who has visitor visa

Hello,

I am US citizen & wanted to sponsor my brother thourgh family based greencard. but he has visitor visa for 10 years..just visited usa for the 1st time..

now my question is..can i sponsor him thorugh family based gc? Is it any affect/issue when he will come next year to visit here in usa through his visitor visa...Can consulate find out that he applied for family based gc?

my brother's son sponsored for visitor visa......

if he already has the visitors visa, the consulate ha sno part in it. You can go ahead and file for him.

I applied GC for my brother and his family 13 years ago and in between he and his family has visited the U.S. several times for vacation. It did not affect his GC in any way. BTW, giving you a visa for 10 years does not mean you can stay here that long. It just mean that you didn't have to keep going to the Embassy to get the visa to travel. Each time you enter the U.S. the Immigration officer will stamp your passport which will indicate the duration you can stay here and you must not over-stay the duration stated.

If you want everything to go through smoothly it is best not to do anything illegal or break the law. This will make your case hard. Also, in his country he must not have any criminal activities because eventually you will need police certification and if he has criminal history I don't think the U.S. will accept him.

Anyway, every country the wait time is different.
