Applying Green Card For My Parents

Hi,

I am a US Citizen and need to apply green card for my parents. I have the following questions:

1. Can we file the I-130 and I-485 together?
2. My mother is currently here in USA on Visitor's visa, Can she stay here while application is pending?
3. If I-130 and I-485 are filled together when can she she get the EAD and Advance Parole?
4. Will she be able to travel back to India if she needs to?

Please help me in this regard.

Hi,

1. Can we file the I-130 and I-485 together?--Yes you can file both forms concurrently.

2. My mother is currently here in USA on Visitor's visa, Can she stay here while application is pending?-- Yes she can, but i think you should make sure that during the processing time, her stay is legal ...means her I-90 is not expired...apply for visa extension etc.

3. If I-130 and I-485 are filled together when can she she get the EAD and Advance Parole?--Yes ..heard I-131 processing takes 3-5 months

4. Will she be able to travel back to India if she needs to?-After getting advance parole, it will be not be any problem.

have heard that consular processing lil faster than sponsoring parents while they are here is US
Please help me in this regard.
