    How Long Can Someone From Canada Come To Usa For A Visit If They Dont Work. My Problem Is My Sister Wants To Spend Some Time With Our Diabetic 72 Year Old Father. While Our I-130 Is In Process. Please Help!

    You left a lot to assumption.Please describe where you are , what status , and what status is your sister is in canada. Who filed the I-130 and what

      We Are In Usa. My Stepmother Filed The I-130 For My Sister. Our Stepmother Is An American Citizen By Birth. My Father And Stepmother Were Married Before My Sisters 18th Birthday.sister Is Now 38. My Sister Is In Canada Where All Our Family Were Citizens Of Canada At One Time. My Father, Sister And I Were All Born In England. I Am A Naturalized American Citizen. My Father, Mother,sister And Myself Lived In Usa When We Were Younger, And Because Of A Divorce My Mother And Sister Went Back To Canada, I Petitioned For My Mothers Green Card In Which She Has And She Lives With Me. Thanks In Advance For The Help! P.s Being My Sister Lived In Usa When Younger Can She Come Back In As A Returning Resident????

        I gather from your description that your sis is still a canadian citizen.
        If she is,she can stay for 6 months
        and can extend her stay by another 6 months.
        Read this page;


        I cannot certainly say if a pending I-130 may hinder her entry but since she has limited
        options; there is no harm in taking a trip to the border.

        Was your sister a US green card holder?
        Returning resident visa (SB-1) visa is applicable only when a US green card holder can prove that his/her long term stay outside US was under circumstatnces beyond control and he/she had no intention of giving up
        US permanent residence. If your sister can prove that, she may be eligible
        for an SB-1 ; it may be hard for her to prove this if many years have elapsed since she left US. you may have to consult an attorney for this special situation.

          My Sister As My Self Was In Usa Under My Dad's Green Card As She Was 10 Yrs Old At The Time.
