  • I130 approved by mom but wanting marriage

    my mother filed for me and now that i know of i have to go back to mexico because i came with EWI. i have been dating my boyfriend for the last 4 years, and we think its time to tie the knot. my question is if it affects the way im going with immigration or will it have a positive conclusion.
    my mother is a USC and so is my boyfriend. what is the best way to go?

    If you want your mother to sponsor you, once you get married, your family based visa category would be downgraded.

    However, it would be fastest to get the green card through your US citizen husband once you get married.

      okay so if i get married things would go alot faster.
      the thing is do i still have to return to mexico?
      how long does this usually take?
      i have relatives but once i get married its going to be very hard for me once i know that i have to leave.
      my biggest fear is that i have to leave and afraid of being denied. i dont know why but this is my biggest fear. we are so close emotionally and it has never crossed my mind to be without him.

      the reason why i think not to getting married is that i would very so dislike the fact that they would say that it is a fraud. that is too deep for me.

      but please give advise.......

        Regardless of who files th eI-130 and I485, unless your mom filed prior to 4/30/2001, you would have to return to Mexico becaus eof the EWI. if you can prove that its a valid marriage then thees nothing to worry about as far as fraud is concerned. Its your decision, but I would go with marraige and filing through your husband, that way when youre applying for the waiver, youll have both a USC spouse and mother. Its standard, yopu WILL get denied at the ConsulATE , will file a waiver and pray that its approved. Thres no other way around it so the key to me is how good of a waiver candidate you become. Use an attorney whos very experienced in 612 waivers once the I-130 is appoved.
