Question on I864

I’m a US Citizen and in the process of filling I-864 to sponsor my parents. I have couple question on the I-864 as follow:

1. There’s a check on part 25 (I-864) says “I have filed a Federal tax return for each of the three most recent tax years. I have attached the required photocopy or transcript of my Federal tax return for only the most recent tax year.” I did not file the tax return for 2003 (since I was in school at that time and do not have any income at all.) Do I still qualify for sponsoring my parents? If yes, do I need to mention it on the I864?

2. I’m still on payment plan for my 2005 Federal tax. Do I still qualify for sponsoring my parents? Do I need to attach the payment form together with my return?

You probably need a co sponsor becasu eyou do not have the 3 returns. Although your incom eprobably qualifie syou, they will specifically reuqest the 2003 return. if you can use a co-sponsor

You need to have the income that is 125% over the poverty guidelines in the US and if you have not furnished your tax returns for the last three years then you need to show a letter of explaination saying what is the issue.
