  • Green Card Through Family Member * Question

Hi Everyone... I am kind of lost here lol.... I have a 5year VISA B1 and B2, I have been admitted here may 9th 2006 under the B1 Visa (business)... but my mother is married here and she lives here since 2000, She's a lawful permanent resident... I know she can apply for me here... but my question is... can I wait here while my case is being processed? or there is no way and I have to leave no matter what and wait in my country... (brazil)?
or maybe study while I wait... what can I do ? or there is no possibility ?

If you are unmarried she can apply for you under Family category 2B but the wait is about 10 years. You can change to student from visitor and then after
you complete your studies , you can go for an H-1b for upto 6 years.

Basically process works this way: your family member sponsors you, however that is not enough for you to get a green card, there has to be a visa number available. For some categories visa number is available immediately - spouses of USC. However for others you will not be able to get a green card till there is a visa number available to you and the worse thing is - approved petition for you does not give you the right to stay in the US legally. Therefore you options are: wait in the home country, or find some other way to stay in the US while you are waiting for the visa number to become available to you
