    Hi

    I am currently on my work visa H1-B and got married to a US citien last week in India. We received a marriage certifiate from India and now would like to file for the green card.

    1. Would it be faster to file for green card using the indian marriage certificate or would you recommend doing a court marriage here and using that to file for the green card?

    2. What are the documents my husband needs to file and with whom? What is the cost involved? Any links will be helpful.

    3. I have a new job starting in January. Can I use my filed paper work-green card status to start working with the new employer?

    4. Also, somebody had informed me that after I file the I 130 and 485, I am immediately eligible to start working for a new employer. Is that correct?

    5. That is...can I start working right away after applying for I-765 application of employment or do I have to wait for it to get approved and only then start? and I think I read in one of your treads that it takes 3 months for approval, is that true?

    1. Does not matter where you get married. You can get married only once. You can't married again until your divorce previous spouse.

    It explains everything.

    3, 4, 5. You can't start working until you get work permit (EAD). In other words, you get I-765 approved.

      How long does it take to receive the approval for worrk permit generally?

      Also, once I file my I 130, 485 and work permit application, will I still be in legal status even though I quit my current job and loose my H1 status? Or do I have to have my H1 status till my I 130, 485 and work permit get approved?

        Also, you said you can't get married twice, so the wedding in India is considered the final thing and nothing else needs to be done in the states? How do we get joint accounts etc without having any official documentation for the states? will the marriage certificate from India suffice for everything?

            You dont need a wedding certificate to open ajoint account. A joint account can be open with anyone.

            An EAd takes 2-3 months.

            Once the I-485 is filed, your in legal status, regardless of your prior status.
