Hello,

Recently, my uncle, aunt and cousin immigrated to US. Their Petition was filed in Sept 93 and they arrived in May,2006. Unfortunately, in this process, my second cousin did not get his call as he turned over 21. (he is 24 now).

* Can he be called by his parents who are on a Green Card by filing a petition for an unmarried child? I have heard that the requirement has or is going to change to 26 years unmarried rather than 21 yrs unmarried?

Can some one please shed some light on this?

Yes, they can file for him now under F2B (unmarried children OF ANY AGE of green card holders) The wait under F2B for INdian citizens is about 10 years currently.

You are mistaken; 21 years or 26 years does not apply in this category.

My Fellow.

I might have another good news for your cousin .he has waited 13 years in a case (1993-->2006) so if your uncle applies for him in a new F2B case .you might pass the waiting list and his priority date will be current.

i recommend to them, having a well experienced lawyer to assist them in this case . i am sure he does not need to wait behind the line for his new case. just might take 1 year for filling d-230 forms and I-864 affidavit of supprt and interview waiting period.

Has anyone got this uptil now? (moving the new priority date to the old one?)

It seems there was a judgement that was passed in July of 2005. Few people have applied using that judgement as the background...I am not sure if that has gone through.
