  • I130 and Tourist Visa B2

    I am a GC holder. My wife is in India waiting for I130 approval. Is it a good idea for me to try to get her a Tourist visa for her and bring her over here. Are they going to give her the B2 visa at all if i apply. Please advise. Thanks in advance.

    Very unlikely.Conflict of intent. (B2 requires non-immigrant intent and I-130 means immigrant intent).
    This is a common situation for spouses of GC holders all over the world.
    And they must wait.

    There is something else which is very possible.
    If your wife is educated enough to qualify for an H-1 visa, you can look for an employer in US who will file an H-1 for her. H-1 , unlike B2 , enjoys
    immigrant intent.

      While we are waiting on the I130 that i filed for my wife, we had a baby and he was born in India. Now, how do i include him into this I-130 application. please advice.

          Sorry, do not know. Call the USCIS service center 1-800-375-5283 and they will tell you the procedure.
