Timeline on Family based GC from India

Can someone please let me know how much time it takes if I apply for my mother GC (family based. I will be USC soon). Her Visitors visa was rejected recently. So, option of getting here and doing the change of status is not there.

BTW, can congress men/women reco letter can help if I ask my mother to try for 2nd attempt for visitors visa?

Also, mother comes as a immediate family based category?

I suggest you go for her immigrant visa after becoming a USC rather than wasting money/time on visitor visa. She comes under the immediate relative category so she will get the visa at US embassy/consulate in INdia in about a year after you file I-130(immigrant petition for relative) for her in US.

Thanks a lot for your suggestion. I have USC interview in March mid and expecting to get Oath maybe by April. But for my family need, it will be a great
help if I can get here in summer around July. This is the reason, I am thinking I will let her try one more attempt of vistors visa just before applying I-130 here.

In case they reject again then I have no option but to file I-130 here. If she gets it, I will get her here and do adjustment of status here.

That's the reason, I was thinking if Congressmen/women letter makes any stronger case when she goes 2nd attempt as a vistors visa.

I do not have a first hand experience with letters from congressmen/senators but from what I read from others' experiences,
they have worked in some justified cases but have also worked against some cases by creating prejudice in the officer's mind.

Please post your mother's last interview in Q and A form, so we may think of something. Also mention ;
*what documents were looked at
*did you send her an affidavit of support?
*Who are the family living with your mother in India
(dad, siblings?)
*What is your mother's occupation in India( job, housewife)
*Do you have any siblings in US or in India?

221(g) IV: why take so long?

Hello Peace,

As I noticed Peace you are assisting lot of people here so I thought to give a try. My father came here before 9-10 years ago and he got chnage of his status from non immigrant to immigrant and got GC but then he went back to India. later he returned his GC to US embassy Delhi.
I filed for his IV again in 2004, he was called for interview in 6/2005 and got 221g. I'm trying to following up with state dept and embassy. Its been already over 6 months. Do you know how long does it take?
I asked congessman and senator and they followed up with embassy.

Do not know specifically the time frame. As you most likely know already that 221g means that they require some more documentation
from you or some processing from their side is required. Did they ask for any documents /evidence in particular from you? If not, maybe it is just a background check that takes long.
Did your dad work in a sensitive area (science, administration) while in India?
Did you write an email to the IV dept of new delhi embassy? What do they say?

They needed police clerance from my dad which he submitted in august'06. I believe it is a back ground check. Yes, I did follow up with Embassy and they said it is still pending and they are waiting response from state dept. My father is 80 yrs old and I can't believe they don't care for age issue either. I contact state dept every week and they told me its a because of common last name. But i'm sure there might be more than that because my dad's case is little complicated because he had GC before even though he returned it to embassy. My father was in military before but he was retired in 1966. What to do with that?

Does anyone has same problem?
