    hello everyone.
    I will like to know whether one can be refused an immigrant visa(family based) when he/she tests positive for HIV.
    Also can a person choose not to be tested?
    Again what are the medical test failures which may lead to a non issuance of visa.

    Being HIV + is one of the health care reasons that makes you inadmissible to US, but HIV + spouses of US citizens can be admitted.
    Other reasons for inadmissibility are Active TB , mental
    disorders which pose danger to others.
    I suggest you go to state dept website travel.state.gov and read the ineligibility/inadmissibility section.

      Anyone who is HIV+ will be denied a visa and would have to go through a waiver process, essentially you would have to show that such person would not be a burden to the US and would have money to cover costs associated with such illness

        .....and would not pose a health danger to the general population. With the costs of HIV medication so high, a waiver is unlikley.
