sibling greencard-interim benefits

Hi,

I need to know if anyone knows anything about this.

I'm already in the US and I'm working on an OPT that expires in June. My brother is a US citizen. Can I file for a green card based on him petitioning me, and then get the interim benefits to obtain an employment authorization and also a permit to travel.

I would appreciate any help in this regard,

Unfortunately you are out of luck, if you brother, who is a USC, petitions you the wait for you to get GC is about 10 years (if not more), during this time you can stay in the US ONLY if you have any other visa or something. Basically, his petition does not give you the legal right to stay in the US (due to the fact that visa number is not current for that type of petition)
