  • Confused about where to file forms

    Hi all,

    I recently became a USC and am ready to send all forms to file a petition for my wife (who is already here). First I want to make sure I didn't forget any forms:

    I-130 Petition for alien relative
    G-325a
    I-485 AOS for her
    I-864 Affidavit of support
    I-765 Application for Employment Authorization

    and of course all the required documents. The only thing that is really confusing to us - and we've invested hours in reading uscis instructions, this forum, and other online sources - are we sending all forms at once to our local service center (we are in Oregon, the service center is Nebraska) or do we have to send I-130 and G-325A to Nebraska and the remaining forms to the Chicago address? Thanks so much in advance for your help.

    All of the forms you listed go the Chicago Lockbox address. Please re-read your filing instructions for the I-485 or the link below regarding the differences in Chicago lockbox address. There is a different mailing address if you use USPS and another address for all non-USPS carriers. Do not send them to Nebraska and do not send them to the local USCIS office!All family-based I-485 applications including the I-765 and the concurrently filed I-130 go to the Chicago Lockbox.

      so you're saying I'll have to send all documents at once-including the I-130-to Chicago, even if the I-130 instructions say to file at the local service center?

        Yes. The I-130 as well goes to the Chicago Lockbox.Initially, I was confused about the different filing instructions on the Forms as well. Bottom line, from someone who has just completely finished the AOS process-SEND YOUR I-130,I-765,I-864, I-693 AND i-485 TO THE CHICAGO LOCKBOX!!!You are required to send in the I-130 alone to the applicable Service Center when you are utilizing the Counsular Processing method. I originally applied for consular processing then returned to the US and did AOS.My I-130 was already approved when I mailed in my I-485 packet and I was only required to send a copy of the I-130 approval notice along with it. However, if your spouse is already in the US and you choose the AOS method, the I-130 can be filed concurrently with your I-485 packet at the Chicago Lockbox. Therefore, my friend, harken unto the voice of reason and send forth your forms to that great bastion of hope that is the Chicago Lockbox lest ye causeth thyself and thy spouse eternal misery and grief!!!LOL

        12/09/2006-RFE response, BC sent to USCIS
        1/03/2007-Interview Letter Received
        1/17/2007-EAD Update!!(Finally)-EAD Card Ordered
        1/22/2007-EAD Card Received
        2/5/2007-Interview at Tampa DO (2006 W-2's Needed for Approval)
        2/6/2007-Copies of W-2's mailed to Tampa DO
        2/12/2007-Email saying Notice Mailed Welcoming New Permanent Resident
        2/16/2007-Green Card Production Ordered Email Received
        2/17/2007-Welcome Notice Received in the Mail.

            Question: If the forms I-130 and I-485 need to be submitted to Chicago Lockbox Facility, how would you reconcile the I-130 instructions on page 3 second column that states:

            NOTE: If the Form I-130 petition is being filed concurrently with Form I-485, Application to Register PermanentResidence or Adjust Status, submit both forms at the local USCIS office having jurisdiction over the place where theForm I-485 applicant resides.

            I also know someone who filed the same to the local USCIS office who already completed the process without problem.

              I think the form instructions are outdated (10/26/05 revision), you have found a bug :-)

              Howiej is right. Everything goes to chicago for family based filing

              Also, Donnely, you forgot about I693- medical....get it done b4 filing the papers, you might get RFE. Read Howiej's earlier posts in this same forum about it.
