  • Changing Place of Birth on Passport before GC

    I am a GC holder who will be eligible for USC this August 2007. I plan to get my parents, who currently hold a multiple entry visa, to US as visitors and then apply for their GC after my oath ceremony. Hopefully, all that works out well. Now, as has been the case with many others, i have a bunch of questions.

    1. The place of birth of both my parent's passports were wrong. They are now in process of getting their original birth certificates and correcting the data. My question is, assuming they it is corrected with a new passport, how does that affect the GC process? I believe if wouldnt affect their current visa but does it reflect in anyway on the GC?

    2. My mother's birth certificate would be in her maiden name. She does not have her maiden name on her passport, which was done about 10 years back. She has a marriage certificate but I am not sure if that has her maiden name. Both her parent's names appear on her passport as well. Will this be an issue? Any recommendations? Would any sort of an affidavit help or be required in this case?

    3. If and when I do apply for their GC while they are here, I know they can continue to stay here beyond their I-94. The question is, Is just applying for their I-130 and I-485 enough for them to continue their stay or do we have to wait for any sort of acknowledgement? If I apply for their GC say in mid-Nov 2007 and say their I-94 expires in Jan-end 2008, will that be an issue at all or it doesnt really matter as simply applying for the GC is good enough?

    I know, these questions have been asked in some form or the other. earlier in the forum. I tried looking through, but some or the other part was always unclear to me.
