I am a USC planning to sponsor my parents for a green card. I have the following questions I am hoping will get answered:
1. They have a multiple-entry visitor visa that lasts until 2014. Can they visit me in the US on that visa and then we apply for the I-130 & 485 concurrently? What if the process takes longer than 6 months (max duration of stay on visitor's visa). Do they have to leave the US? If so, do they have to apply for Advance Parole (I-131)?
2. Can I apply for the I-130 now while my parents are in India. Would they be prevented from entering the US on their visitor's visa (at the Port of Entry) if their 130 is still in process or has already been approved due to intent to immigrate?
3. How long is the I-130 approval valid before which we should apply for theit I-485?
4. What if they are not able to hold on to their I-94 cards at POE - the immigration officer does nto give it to them? How else would they prove legal entry into the country?
5. Can parents travel back & forth (US-India) while their I-130 is in process with their existing multiple-entry visitor visa?
6. The affidavit of Support I-864 needs to be valid, complete and correct - what supporting documents (copies/originals) do you reccommend be provided by the sponsor/applicant.
7. Can we submit I-693 (Medical Examination); G-325A (Biographic info); I-131 (Travel Document); along with I-485 & I-130?
8. Can I-693 be waived since my parents are too old for some vaccinations/tests.
9. Do my parents need local police clearance certificate for filing I-485?
