  • Question about I-130

    Hello,
I am a permanent resident and I want to petition for my illegal husband.
He came to USA with his parents when he was 17 and they entered legally with a tourist visa. This was about 8yrs ago.
    My question is this:
1- Where exactly do I send the I-130? to the service center assign to my state which is the one in Texas, or do I send it to the one in chicago?
2-I have sent my citizenship application, should I wait until I am approve to file?
3- One I get my citizenship, do I send the rest of the forms like the I-485 to the chicago office or to where I originally sent the i-130?
4- Question # 14 on the I-130 asks for the place of admission and class of admission for green card. I got my green card in NJ but we filed in the Vermont center. Also I got my residence automatically after my dad was approved for his religious status. On my green card there is a category # SD8 is this the class of admission they are referring to?

    Thanks for all your help!

First of all you should NOT file now, but only after becoming a citizen. If you file now, your husband will be detected as an illegal and will be deported.

If you file after becoming a citizen, file only after getting a waiver. They allow citizens to get a hardship waiver (get a very good an attorney because the waiver is very difficult to get) for your husband because he overstayed more than a year. It is not possible for illegals having overstayed more than a year to adjust without a waiver.
