  • Been waiting for 3 years.. Pls help!

    My Immigrant husband and me from Philippines got married in May 2004 here in my home country. He then filed I-130 for me last May of 2004 and got approve July 2004. Now he had filed for USC and had fingerprinting and just waiting for the interview schedule. Now here are my questions:

    1. After interview, how long will it take for him to get me after filing all the supporting papers (Adjustment of status, Following-to-join, etc.) ?

    2. Is there a way that I can get a tourist visa to visit him? I was denied when I attempted to get a business visa even sponsored by the company I am in. And I'm afraid that I might get denied again for tourist visa.

    Pls help.. 3 years is too long. We only get to see each other every year, and only 15 days in a year.

    After he becomes a USC, the petition(spouse of GC holder) he filed for you in 2004 should automatically be upgraded to the unlimited category(spouse of USC). Depending on which service center processes this petition,(vermont is the slowest) and the consular processing at phillipines, you should be able to get the visa at phillipines in about a year. To avoid that wait, you could apply for a K3 visa after he becomes a US citizen and wait and work in the US instead of in phillipines.

    Let him call the USCIS and make sure the peition is upgraded to unimited
    category after he becomes a USC. He will have to file some other forms for K3.

    No point applying for a visitor visa. K3 is a better option.

          Unfortunately he filed it in Vermont. By this month, we are expecting for a notice for his interview schedule. Would you know what is my estimated time frame if he will get his USC in July, how long will it take for me to get there if he applied for K3 immediately after the USC?

            He will have to file another form I-129f for your k3 visa. That will be processed by missouri service center. Ususally it takes 3-4 months to get a k3 but also enquire from the embassy in the phillipines about their local processing times.

            In the mean time start collecting all documents for your k3.
            marriage cert., birth cert, local police cert. etc.

              You mean, the !-129F will go directly to Missouri Service Center even if the assigned service center in New Jersey is Vermont? Or is it possible to file it in different Service Center?

                All k3 visa petitions are processed at missouri irrespective of where the I-130 is processed. Your husband will have to file the I-129f with the USCIS office which will approve it and send it to Missouri.
