  • Green Card for Parents: US or India?

    My parents are visitng US (usual trips they have been taking for last 5/6 years). This time since I am a citizen, I'd like to apply for their GC. My friend's father got it in 9 weeks (last year). Looking at some other postings, it seems that it contradicts other's experience.

    Option 1: Apply here when they are here - use a Lawyer
    Option 2: Apply in India after they go back
    Option 3: Apply here - but they go back and receive the GC in Mumbai

    Suggestions/Comments?

    You should consult an attorney if you could use option 1 because it carries a technical risk (B2-nonimmigrant intent vs GC immigrant intent).

    Consular processing may delay the visa because there is a new bill in the senate that puts a yealy cap on parents' gcs (currently in unlimited
    category). The bill may or may not pass but if it does, your parents' visas may catch the cap if you go by the consular route.

      I 130 parents.

      UCIS has approved I-130 petition for parents on 10.4.07. But the beneficiaries have not yet received any communication either from NVC or local consulate.
      What happens to such applications with the passing of new bill?

        Cannot say. Depends on the actual effective date of the bill, if it passes.

        Just keep a watch on the daily news about the progress of the bill.
