    hi,

    i have 10 years multiple visa for usa issued to me 4 months back.Could not travel due to unavoidable circumstances , My sister is usa citizen. We are filing for FAMILY based greencard under F 4 category [ brother - sister ]

    my question was ,can i visit usa after filing I 130 on my valid visa ?? Since i have heard after filing for green card you cannot travel to usa since you are considered as an prospective immigrant.

    We are happily based here and have no intentions of staying there . But for our kids and better retirement life we propose to file it for future.

    Can anybody pl let me know wether we can travel ??

    You may or may not be stopped. Depends on the computer showing up a pending petition and the officer's discretion.

    What you can do in case you are stopped, is to show all evidence that your trip is temporary and you will be returning. That is the law in relation to B2
    (returning home) and that is what they will be concerned about even if your petition is pending. Show everything that you showed to the officer at embassy interview.

    PS you should weigh pros and cons of filing an I-130 under F4;

    *it takes about 11 years in the current scenario.
    *You may not get another
    10 yr visa once this one expires, if your I-130 peition is filed.
    *There is a bill in the senate that will scrap F4 if it passes.
    *If you are doing I-130 for petition for your kids, you should consider your children's current ages and take into account aging out if they will turn over 21 by the time the visa number arrives.
