  • sponsoring parents that are illegal

    hello. i am a U.S. citizen and am 21 years old.
    my parents are currently illegally residing in the country. is there any possible way to sponsor them? i want to do this as soon as possible b/c i heard that when the new immigration bill passes this year, i heard it will be harder to sponsor family members.

    please help as i really am in a crisis.

          their native country is south korea. they have been in the U.S. since 2002. (5 years)

            It will not be possible to adjust status with an uninspected entry.
            It is even very hard with legal entry if your overstay is more than 180 days.

            I suggest you talk to a VERY GOOD attorney.
            DO NOT PETITION ON YOUR OWN. THEY WILL BE DETECTED AND DEPORTED.

            Departing US for home may be an option if they still have their passports; since they do not have a record of an entry to US, and there is no departure inspection in US anyway. They could show that they never entered US and you could petition for them so they could collect their visas in south korea. Risky process; will involve lying on the petition.
            TALK TO AN ATTORNEY IF THIS IS POSSIBLE.
