    My husband and I married in Dec 2006. I am a US citizen, he is from England. Does anyone know if there is a LEGAL way for him to move to the US before we start all the immigration paperwork such as filing the I-130? Can he go ahead and come over and file the paperwork from here, legally? Or do we just have to file the I-130 then the I-129F and go from there for the K-3 visa?

    No, there is not.

    He could come over on his Visa waiver but adjusting status on a VWP is not advised
    because you are already married. You are not supposed to enter on VWP with the intent to stay permanently.
    That would be visa fraud.

    Just take the I-130 and K3 route. That is the best option.

    By the way, where did you both get married? Was it in US? Was he visiting you on his visawaiver?
