Case summary:
1)I came to the US on a Business visa in 2002.
2)Then I overstayed and applied for a political asylum in Sept. 2002.
3)Asylum case was referred to the court Dec.,2002. referral reason: lack of detail(My Paralegal was to blame for that, because he told me not to be too detailed, too wordy)
4). I got married to an American citizen in July of 2003. I met my husband right after I arrived in the US). on the second court hearing about my asylum case, I told judge I got marriage to an American citizen. Judge suspended my asylum case waiting for my I-130 petition approval.
5)My husband filed I-130 for me, and we had our 1-130 marriage interview in August of 2005. I did pretty well since we are genuine marriage. We even did have anyone help us prepare for the interview.
Question:
1)It's been almost 2 year we haven't heard anything from INS since the I-130 marriage interview. What's going on here? My lawyer made inquiries 3 times. The first time(6 month after the interview), the officer reply that she was still reviewing the case. the second time(1 year after the interview) the officer said she had referred the case to special investigation unit. the third time(1 and 1/2 years after the interview), the work staff said they didn't know what's going on with the case.
2). How can I get a work permit? Since I have an asylum case pending, I can't file I-485 at the same time, so I am not entitled to a work permit. And I can't get a work permit either from my asylum case because the clock had been stopped due to my marriage case. Right now I'm in limbo literally. I'm caught up in the bureaucracy. I'm an MD, used to work for a big pharmaceutical company doing clinical research, but I can't enter my professional field since I don't have a work permit. I have left my professional field for 5 years. It's very frustrating. It's not about my living. My husband is a very nice person, he never allows me to work here illegally. He supports my life 100%.
Does anyone have any idea about my case? I'm desperate!!! I can't go back to my country. I can't see my 11-year daughter either who is in my country. Every time she asks me:"Mommy when are you coming back", my heart is just broken! Since my case is pending, I can't bring her here either. Please help me!!!
