Urgent: Birth Certificate Question for Parents and Sister's Green Card Sponsorship

  • Urgent: Birth Certificate Question for Parents and Sister's Green Card Sponsorship

    Hi,
    I am US Citizen. My parents arrived today on visitor visa. And my sister is in USA on H4 visa since b'cos her husband is on H1 visa [his labor and I-140 is cleared but waiting for 485 filing which might take another 1 year].

    I want sponsor green card for my parents and my sister now.
    I am going to file I-130 and 485 simultaneously for my parents b'cos they are in USA on visitor visa.
    And I am also going to file I-130 for my sister.

    I need to submit my Birth certificate, my sister's Birth certificate for her I-130 and my parent's birth certificate (for I-485)

    I have a following question on Birth certificate to apply for their green card:
    My Birth certificate and my sister's Birth certificate issued in Mumbai shows our father's name as Maheshkumar

    My USA citizen certificate and USA passport shows my name as Raj Mahesh Khanna.

    My father's Birth certificate shows his name as MAHESH

    Question:
    1.> Does difference in father's name as mentioned above as Mahesh and Maheshkumar creates any problem for my parent's as well as my sister's Green card sponsorship?

    2.> I know that Indian counsulate in San Fransisco provides birth certificate based on Indian Passport.
    And my sister's indian passport and my indian passport shows same name of our father as MAHESH. So can I make new Birth certificate from SFO - Indian counsulate and use this new Birth certificate instead of Birth certificate issued in Mumbai to avoid confusion? If YES, then do I need any additional documents for this?

    Your father will need secondary evidence for his bc.
    Which means, in addition to his original bc with the incomplete name , he should provide the following;
    a) his school leaving certificate, college diploma with his full name ( if they have the full name)
    b) an affidavit, from a relative /friend elder to him attesting to his date of birth, place of birth , full name and his parents' names.

    The birth certificate from the embassy could work but you will have to provide them a document which has his full name.

      But I think you misunderstood my question.

      My Birth Certificate issued from India - shows my father's full name as Maheshkumar Utpal Khanna.
      But my USA Citizenship and Passport shows my name as Raj MAHESH Khanna.

      So my question is there is mismatch of father's name in my Birth Certificate issued in India and my USC certificate.

      I made one more Birth certificate from Indian counsulate in San Fransisco based on my Indian Passport. And it says that my Father's correct full name as MAHESH UTPAL KHANNA.

      So which Birth certificate should I use? I mean the one which I got from India which shows MAHESHKUMAR Or
      the one which I got from Indian counsulate in San Fransisco which shows correct name as MAHESH?

        How did your dad's name come out to be different in your USC from your original bc? You should have got it corrected on the USC.

        The most important thing is your father's name should EXACTLY match the one on your bc and the one on his bc. That will make sure he is actually your parent.Also, this name should match the one on your USC.

        *.Your original bc from India is the authentic bc. Take your dad's name on that bc as the correct one because the full name is mentioned.(MAHESHKUMAR UTPAL KHANNA) Proceed from there;

        1. Provide secondary evidence of your dad's bc like I mentioned in my last post. The secondary evidence you provide , affidavit etc. should mention his full name as MAHESHKUMAR UTPAL KHANNA.

        2. Get the name MAHESHKUMAR UTPAL KHANNA corrected on your USC,
        if this is possible. I guess it should be by showing your original Indian bc.

        This way all 3 will match. your dad's name on your bc, his bc(secondary evidence) and your USC.

          How about if I do not use Birth Certificate which I got from India.

          And I use the Birth Certificate which I got from Indian Consulate in San Franscio. B'cos this new Birth Certificate has correct name of my father "MAHESH" which matches with my USC certificate , USC Passport and my father's Birth Certificate too.

          Can I use this new Birth Certificate which I got from Indian Consulate in San Franscio?

          Does Immigration allow us to use the Birth Certificate issed by Indian Consulate in San Franscio?

          Do we need to provide any more documentation if we want to use this new BC issued by Indian Consulate?

            First of all your father's bc is incomplete because as you said the name on it is MAHESH, which is not a full name. There has to be a last name.
            This requires secondary evidence like I mentioned.

            As far as I know, they require original municipal certificates. And secondary evidence if such a cert is incomplete or not available. I am not sure SFO cert will be accepted. Read the birth certificate header on this page;
