    Hi there,

    First i want to tell you that if you did apply your tourist visa with your married situation, now you can't be able to put yourself as "not married man" before. USCIS will find all your information with FBI check later, and you will be in trouble. So don't be lie just tell all the truth if you want to file your application.

    About the gap between your wife and you, they will take that serious. So if your marriage is true, you have to get all and enough evidences as you can to prove your true marriage.

    Lastly, you have no choice but get a divorce with that lady whom you lived with for a couple years in your country before you file with USCIS here.

    I came to US about five months back on tourist visa. My wife is an US Citizen and she is divorced three months back from her previous marriage. Then we got married last month. I don't have a job right now and therefore she is supporting me. We are living together.

    Now, I want to share something about my life before coming to US. In my home-country, I was living with a lady and I was never legally married to her. We never had any marriage ceremony or marriage photographs. We went to a court in, paid lawyer few hundred bucks, and he printed out some affidavit and we both signed. This affidavit doesn't have any legal binding on both of us. Later, when I applied for US Visa (the tourist visa on which I came to US), i mentioned my-self as a married person with her details on the visa application. We were 'so-called' married for a couple of years.

    My questions are :

    1) When I will file my I-130 petition, can I show myself as "not married before" and mention just I am married to the USC ?

    2) Are they going to verify my details as it was on my original visa application with the details I am going to provide in the petition ?

    3) There is a age-gap between me and my wife (USC). She is older than me by 12 years. Is it going to create any problems to us during immigration ?

    I would add here, that I can not divorce the lady in my home country, because we have never been legally married. Frankly speaking, I just want to keep her out of the picture. I would really appreciate all your help and suggestions in this regard.[/QUOTE]
