  • Time taken for I-130/ visitors visa

    I applied for I-130 for my mother in April 2007 who is staying in India.
    I have a couple of questions:
    1) How much time it takes to get the I-130 approved? The website says that it is processing Dec 2006 at california center.
    2) In the meantime can I sent her the papers for getting her a visitors visa?

    Any suggestions on this is highly appreciated.

    Hi:

    The dates on the website for processing I-130 from the CSC are for limited visa categories only. That means that for your mother's I-130 to clear it will take almost 3 months. If you filed in April 2007, you should have already received the I-797C Notice of Action indicating that the USCIS has received your application. Now they will review the I-130 app and supporting docs and will let you know if they approve the app or they need more evidence/info. In the second case, they will send you a RFE. Lets hope they don't!

    Overall, after the I-130 is approved the entire process should take another 5 months to complete depending on how strong your evidence and supporting documents are. If they are clean enough then the total time from start to finish is 8-10 months to get a GC (not physical card but stamped)

    It is not advisable to now file for visitor's visa.

        I am also in the same boat planning to apply for I-130 for my mother.

        So, after I-130 approval, what is the next step and how long does it take for INS to transfer that file to NVC and how long will it take to get interview letter from U.S consulate in India?

          Hi visa_time,
          After I-130 is approved by USCIS:
          1. USCIS will send the file to NVC within a week and a notice of action is sent to you that the file has been approved and has been forwarded to NVC for further processing.
          2. Once, NVC receives that file they will send a letter to your mother stating the same.
          3. After that NVC will send you a packet of documents that will include:
          a) AOS fee bill of $70 that you will have to mail to NVC.
          b) DS-3032 Choice of Agent form
          NVC will also send a Choice of Agent form DS-3032 to your mother.
          You will have to have your mother fill out that form and send it to NVC directly or send it to you and you can mail it in.
          This packet comes to you within the next 3 weeks time.
          4. Once you have submitted the $70 fee and your mother has submitted the choice of agent form then the NVC will send you (the petitioner) the Affidavit of Support form instructions (where to download etc.). You have to fill this out and send it to NVC with the supporting documentation. This step takes another 3-4 weeks time after you have submitted info in step 3.
          5. After NVC receives the I-864 form they will send you (or whoever the agent is) the IV fee bill of $380 which you have to pay to NVC. This step takes another 2-3 weeks time after you have submitted the info in step 4 and NVC has received the same.
          6. If everything is okay - and I mean EVERYTHING - this is the last step so NVC verifies entire documentation again starting from I-130 app all the way to your I-864 form and if everything is okay then you get the DS-230 form from the NVC which you will have to fill out part I for your mother and she will have to sign it and then send it back to NVC- Part II does not have to be signed yet. This step takes another 2-3 weeks. Remember, once you send this form in - that means you have the necessary documents for the interview i.e. original birth certificate for you mom, police clearance certificates, passport copies, etc.
          7. Once NVC receives the DS-230 and if everything is fine - your mother's file will be sent to the Consulate in the country of origin. For example, Mumbai, India.
          8. The consulate in the country of origin will then send a interview letter to your mom scheduling an interview for your mom 6-8 weeks in the future.

          In total, the entire process will take atleast 6 months are I-130 is approved.

                the parents, if visiting the US on visitor VISA, can stay in the US?
                or do they have to go back?

                  I am applying for my mother. do I have to attach her passport and photo's with I-130 form? if yes, how may photo's? what other documents to attach?

                    USC's Mother in USA, B2 expiry in 2yr, best way to file GC?

                    Hi, my mother is in USA on B2 and "she plans to leave" in either 5 wk or 4months depending if I-94 extension is approved. Because of unfinished business back home she does not want to stay here long. Her B2 expires in Sep2010.

                    Q1- I am filling for her GC, so i just file I-130, or include 485 as well, or include I-134 as well, or include I-864?

                    Q2 - should i go for CP or processing in USA? i.e., should i ask her to take two risks a) stay beyond I-94 till extension decision is made, b) should i ask her to even stay longer till 485 is filled (but then i need 131/adv parole) or do we do US process and if needed request moving to Consular?

                    I am sure this is common cookie cutter situation, but i really couldn't find a cookie cutter answer on thjis forum or immigration.com. Been reading forums for a week, since i filed her 539 extension. I made the subject cookie cutter so hopefully will 'quickly' assist others in future. Can anyone provide one, please?

                      Citizen filling I-130 for child under 21

                      Hi.
                      my father is US Citizen, and he has filled i-130 form in September 2013. USCIS reviewed my case on 7th of feb 2014.
                      and then again reviewed on 16th of May 2014 in which they said, ,
                      ''your Alien Registration Number was changed relating to your I130, IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN. Please check our website at www.uscis.gov for further updates on your case. Please wait until the end of normal processing time before calling customer service at 1-800-375-5283 for live assistance.''

                      - what does that actually means ?
                      and how much time it will take ?
                      till when i can get visa in hand ?

                        Need to apply for Green Card - automatic Extension of stay of B2 Visa date limit?

                        I intend to reapply for my green card which I gave up in 1990 after being in the US for 13 years. My wife of 40 years is a U S Citizen and I am currently in the US on a B2 Visa for the next 5 months.
                        How do I proceed - apply for an extension of stay on the B2 Visa - (Form I 130?) as well as I 485?
                        MORE IMPORTANTLY
                        Will I be able to stay in the US beyond the next 5 months if these applications are pending? Thanks for your help!
