  • Married, kids, illegal 21 year?

    I have been here for 21 years illegally even though I have paid taxes from day one (you could get social security cards back then). I have three kids (all American citizens) and just married their mom. We waited till now to get married because she just got her citizenship. I have been out of the country twice in the 21 years and returned on a tourist visa both times.
    What do you think the chances are of getting my visa fraud waived if I filled a I-130?
    I can't afford to get deported for 10 years.

    Any thoughts would be helpful

    1. Get a lawyer. Best thing in my opinion you can do in situations that aren't straight forward.

    2. My dad came to Canada from Scotland in 1960 and was never declared a citizen. Just like you, he was given a social security number (or social insurance number as we call it in Canada) and worked, paid taxes, etc. for 30 years. Since 9/11, changes obviously have been made and getting a passport is pretty important. Since my dad was not a citizen, he had to then go through the process which took him years. (More ironically is that he works for the Canadian government)

    Any ways, what I am trying to say is that you shouldn't have a problem even though you fraudulently overstayed your visa. Because you are now marred to a US citizen, I am sure there are ways around it. I may be wrong here but contact a lawyer and see what they say. I'm also sure that someone on the forum knows more than me on your specific situation. Good luck!
