  • I-130 - Help to answer a question in form

    Hi, I am completing the I-130 for my brother who is not married, but has a domestic partner 5 years ago and they have to kids. I am not sure how to complete the marital status question. Since he is not married, what should I respond to be able to list his family members? The only options are: Single, Married, Widowed, Divorse or Married, but any applied to him.

    Any assistance will be greatly appreciated.

    May be write a cover letter or consult a lawyer.

      He would be considered single. The US doesn't recognize common-law when it comes to immigration procedures.
