Hi to all! i hope somebody can enlighten me regarding my case. My mother is an LPR of USA, she filed an F2B for me on April 1996. For the year 2003 I never received any communication letter from the NVC.
On March 2006, I received NVC's notice that my Visa Number is already availabe and I can now apply for my Immigrant Visa. Now, my problem is on Dec 2004 I got married and now I have a 2year old son. I responded to the letter and told NVC that I am still interested in migrating in the USA but did not mention that I am already married. Until I received my Fee Bill Form and then I stopped responding and consulted an Immigration Firm.
I understand that to qualify for the F2B, I cannot be married and I am out category.. But what if I also have an F4 Petition filed by my sister? She filed it on Jan 2006 and I have the copy of the Notice of Action. Is there any possibility that I can retain my F2B Priority date for the F4 petition? Coz here in the Philippines, we have longer waiting period for F4, and by the time that my F4 becomes current my son (who is only 2years old now) will "aged-out" and will have the same situation that i had..
