My story is a little long, so please be patient.
-My family and I came to the USA legally in 1994, I was 8 years old, and on a B2 visa. -- -The visa expired in 1998, and since then my family has been appealing the case with a lawyer.
now the complicating part:
I moved out of my family’s home when turned 18,
I moved in with who is now my husband. ( we got married in June, 2006.)
My family was extremely upset because he is out-side of our race.
Things got so bad that I had to get police to escort me to my parents home to get my birth certificate. I begged for nearly four years for a copy of my
I-94 and passport, (so my husband could petition for me), but they refused.
SO I filed the I-102 and received a copy of my I-94,
then I filed the (freedom of information act) which will probably take another year.
Than all of the sudden yesterday my fathers lawyer contacts me and tells me that since I've been married, that I am considered to be out of status, before marriage, I was considered to be an asylum. This made me panic, I did not know this. this angered me so much that I told my father that if he doesn’t give me my paper work then I will sue for it, and that he is ruining my life, then he finally agreed to send me what I need. I haven’t received anything yet so we will see.
So now my husband is going to file the I-130 first because we cant afford to file everything all together. And we cannot afford a lawyer either. Please give some advice and tell me I will be OK!
I was a minor when all the problems happened, until we got married, which put me in the undocumented (illegal) category. Will I get in any problems? Am I taking the correct steps. I really need some direction!
