  • GC Holder wants to marry current F1 holder

    Hi All,

    I would like to know whether a F1 visa holder can get married to a GC holder while the F1 holder is in USA? Will the F1 holder be deported due to the marriage with GC holder? What benefits will the F1 holder get due to marriage with GC holder?

    Also, will the F1 holder's international students fees (education fees) go down and be able to pay local resident fees?

    Your reply is greatly appreciated.

    Thanks!

    There are no problems with this marriage. Your F-1 status will not be affected by this marriage but you will not receive any immediate benefits from this marriage.

    Your gc holder spouse can file a family based ( F 2A category) immigrant
    visa petition for you after marriage (form I-130). The petition will be approved in a few months but the visa wait under this category is about 5 years , so you won't be able to adjust status from F-1 to Green card till your visa number comes about 5 years from now. You must maintain your F-1 or other status ( eg H-1 ) till then.

    Other possibilities;
    if your gc holder spouse will become a citizen before your visa number comes
    this petition will be upgraded to immediate relative of a USC from F2A category
    and will be processed fast.
