Dear Sir/Madam,
I am hoping you can help me in what I think will be a simple case. My 15-year old brother is here visiting from Sweden. He has a tourist visa (B2), and is allowed in the country until November. He has decided that he wants to stay with me and my husband to attend school here for a year.
What are our best options as far as him staying here legally?
I am a permanent resident, my papers have been sent in for my citizenship, but I have not yet heard a response. My husband is a US citizen. I know I can apply for his green card once I am a citizen, so what can we do until then?
Can we leave the US on a little trip and if we do, will they stamp his passport again, allowing him to stay another 6 months from the day he enters?
Unless there's a better option, i think this might be our best bet right now, to allow him to stay while my papers are being processed for citizenship.
Will they stamp his passport for sure once he leaves the country, say on a weekend trip? or will they just let him in again, being that his stamp is good until Nov? His return flight is scheduled back to Sweden for early September, so we want to find a solution as quick as possible.
Or is it easier to file for an extension for his current visa? Do you see any problems with them approving it, being that he's 15 and should be going to school?
