Petitioner passed away

Dears,
Thanks a lot for your below reply.
But my father (original petitioner, green card holder) passed away four years ago, and I have to substitute new petitioner.
My brother is U.S-citizen and will be the new petitioner.

(I married two years ago, and my original petition was approved in 1995).

Now, are we (my wife & I) eligible for green card ?

Please help me & reply.

But couldn’t I keep my old preference date (1995) ?

I mean, my petition was approved in 95, and as petitioner was my father who died in 2001, and if I change petitioner to my brother (U.S-citizen), I should start petition from beginning ?
If I could keep old P. date, then several more years I should wait ?

Do you have any facility to act as my lawyer officially to get advise & proceed to ?
