I need some help. I married an illegal alien from Albania. She initially came here in 1997 with a J-1 visa. The Visa expired in a year and she applied for Asylum in 1998 and was denied. So, an Immigration Judged issued a Voluntary Deportation Order.
She never acted on the order and moved to another city – she never heard from the INS again.
Now we are married (I am a US citizen) and need to get her papers straightened out.
What should I do? I want to file an I-485 (change of status), but I believe that the deportation order is still open.
An appeal on the previous decision expired years ago (you can appeal 30 days after denial).
What should I do? Please help!!!
