  • Marrying US Citizen

I just became US citizen. I want to marry my girlfriend who has been here in US for about 6 years and her visitor visa has been expired years ago.

    1. After how long I have been naturalized, I can marry her and file green card?
    2. What is the procedure to obtain a marriage license?
    3. How long will it take to get her green card approval?
    4. What is the possibility that she will get green card and she won't get deported?
    5. What supporting document do I need to gather before I file the case?

    I appreciate your kind information.

    1. After how long I have been naturalized, I can marry her and file green card? Yes.
    2. What is the procedure to obtain a marriage license? Go to your local's probate judge office, along with your girlfriend, bring her passport and your driver's license, any divorce decrees if previously married, pay the fee, and that is it.
    3. How long will it take to get her green card approval? In the normal scenario around 4-8 months.
    4. What is the possibility that she will get green card and she won't get deported? If she has not been deported by now, then once she files for AOS her status is "pending" not "illegal" and there is no reason for deportation. In fact, overstaying her visa will be forgiven and can not be used against her. So, chances of not being deported is %99.9
    5. What supporting document do I need to gather before I file the case? Please read all of the info here: https://www.immihelp.com/family-base...ard/index.html and come back if you have more questions.

Thank you so much for the information.

Do I have to hire an attorney to process or I can do it myself. If I can do it myself, what forms should I file and what are other necessary documents I should submit?
